If you want to understand litigation in the County Court small claims track, then we now recommend Patricia Pearl's book: "Small Claims Procedure: A Practical Guide."

This book is excellently laid out and is a thorough but readable guide for the ordinary person who wants to bring any kind of claim in the County Court.

Can I Claim?

What about £12, can they charge that?

Yes. If it costs them £12 because of your breach of contract, then yes this is what they can charge. If you believe that it costs them £12, then accept this. There is evidence to suggest that it costs far less than £12 - pennies in fact. The banks have not offered any evidence to support the claim of £12 for a breach of contract.

The vast majority of people do not believe that it costs £12, and successfully claim the full amount back from their bank.
