Provisional Findings report -Northern Irish personal banking

We think that this report is essential and we believe that it shows convincingly that the bank make profits from their penalty charges, that they know about it, that they depend upon it and that they calculate for it.

We have yet to see the effect of this report in court as it has only recently been published and it has only just come to hand. However, it is difficult to imagine that any bank which went into court against this document could possibly win.

Although it relates specifically to Northern Ireland, it clearly reads across to the UK mainland banks as well. It would scarcely be possible for one of the contributing banks to claim that their financial performance was different or substantially different from that in NI.

It would also be very difficult for any non-contributing bank to say that its own financial performance was somehow remarkably different from those banks which took part in the research.
